ADC asks Court order INEC to restore leadership recognition

The leadership of the African Democratic Congress (ADC) under former Senate President David Mark has approached the Federal High Court in Abuja, seeking an order to overturn the Independent National Electoral Commission’s (INEC) decision to de-recognize its executives.

INEC had, on April 1, removed the names of Mark as National Chairman and Rauf Aregbesola as National Secretary from its official portal, triggering the legal challenge.

 

In a motion filed on April 7 by his counsel, Sulaiman Usman (SAN), Mark asked Justice Emeka Nwite to issue a mandatory injunction nullifying INEC’s actions, including its refusal to monitor the party’s congresses and convention pending the determination of the suit.

 

The ADC chairman also urged the court to compel INEC to immediately restore and maintain the names of all members of the party’s National Working Committee (NWC) in its records, as they existed before the dispute.

 

Additionally, the motion seeks an order restraining INEC from recognizing any rival leadership or tampering with the party’s records until the case is resolved.

 

The application follows a March 12 judgment of the Court of Appeal in a suit filed by Hon. Nafiu Bala Gombe. Mark’s legal team argued that the appellate court had directed all parties to maintain the “status quo ante bellum,” meaning the last uncontested leadership structure before the dispute began.

 

According to the lawyer, as of September 2, 2025—when the suit was instituted—Mark was the duly recognized national chairman, and the party’s leadership structure was already in place.

 

He contended that INEC misinterpreted the appellate court’s ruling by removing the leadership from its portal, thereby creating a vacuum and undermining the party’s operations.

 

Usman further argued that the commission’s actions could render the suit ineffective and prejudice the positions of Mark and Aregbesola, insisting that the court has the power to grant interim relief to restore the status quo.

 

In a separate motion, Mark also requested an accelerated hearing of the case, citing the need to resolve the leadership dispute quickly due to its impact on the party’s administration and participation in political activities.

 

The legal dispute stems from an earlier suit filed by Gombe, a former Deputy National Chairman of ADC, who challenged the party’s leadership. Justice Nwite had previously declined to grant an ex-parte request to halt the Mark-led leadership, instead directing all parties to be put on notice.

 

The matter is expected to continue before the Federal High Court as parties seek a definitive resolution to the leadership crisis within the ADC.

The notice, posted on the mission’s official X account on Thursday, stated that visa services at the Abuja embassy have been temporarily suspended.

The development comes shortly after the U.S. Department of State authorized the departure of non-emergency government personnel and their families from the Abuja embassy, citing worsening security conditions in Nigeria.

 

In a revised travel advisory that has generated reactions online, the Department urged American citizens to reconsider traveling to Nigeria due to concerns over crime, terrorism, kidnapping, and civil unrest.

 

Nigeria is currently listed under a “Level 3: Reconsider Travel” advisory, with some states placed under the stricter “Level 4: Do Not Travel” category.

 

States such as Borno, Jigawa, Kogi, Kwara, Niger, Plateau, Taraba, Yobe, and northern Adamawa were flagged for terrorism, crime, and kidnapping risks. Troops of Operation Hadin Kai has successfully repelled a coordinated terrorist assault on a military base in Benisheikh, Borno State.

The Defence Headquarters disclosed that the attack occurred around 12:30 a.m. on Thursday, when insurgents attempted to overrun the Brigade Headquarters of the 29 Task Force Brigade.

 

According to the military, soldiers responded with superior firepower, forcing the attackers to retreat and abandon their mission. Authorities described the failed assault as an indication of desperation by terrorist groups following recent setbacks in ongoing operations across the North-East.

 

Despite the successful defense, the military confirmed that some personnel lost their lives during the encounter. The Chief of Defence Staff, Olufemi Oluyede, paid tribute to the fallen troops and extended condolences to their families.

Suspected fighters of the Islamic State West Africa Province (ISWAP) have reportedly killed a brigade commander of the Joint Task Force, Brigadier General O. O. Braimah, during a midnight assault on a military formation in Benesheikh, Kaga Local Government Area of Borno State.

Security analyst Brant Philip disclosed the development in a post, noting that insurgents launched an attack on a Nigerian military camp in the town. He said multiple fire sources were observed in the facility during the attack, indicating intense fighting.

According to him, Brigadier General Braimah, the commanding officer, was killed in the attack. He added that the slain officer is the highest-ranking casualty since a similar ambush in late 2025 that claimed the life of another brigadier general in the state.

 

Local sources, as cited by Daily Trust, also reported casualties among civilians, members of the Civilian Joint Task Force (CJTF), security personnel, and several insurgents during coordinated attacks in Benesheikh and Pulka in Gwoza Local Government Area.

 

Residents confirmed that the brigade commander died during a fierce exchange between troops and the attackers. A local resident, Lawal Benesheikh, also corroborated the incident in a social media post, describing the attack as devastating.

He lamented that insurgents stormed the military formation in large numbers, resulting in significant casualties, and prayed for the repose of those killed in the attack.

In a revised travel advisory issued on Wednesday, the department said the directive took effect on April 8, 2026, urging American citizens to reconsider traveling to the country due to escalating risks such as crime, terrorism, kidnapping, civil unrest, and uneven healthcare standards.

 

Nigeria remains under a “Level 3: Reconsider Travel” classification, while 23 states have been designated under the highest alert, “Level 4: Do Not Travel.”

 

Newly added states to the Level 4 category include Plateau, Jigawa, Kwara, Niger, and Taraba.

 

The advisory noted that several northern states — including Borno, Jigawa, Kogi, Kwara, Niger, Plateau, Taraba, and Yobe, as well as parts of Adamawa — face heightened threats from terrorism, armed violence, and kidnapping.

 

In the southern and southeastern regions, Abia, Anambra, Bayelsa, Delta, Enugu, Imo, and Rivers states—except for Port Harcourt—were also flagged over persistent concerns about violent crime, abductions, and civil unrest.

 

“The security situation in these areas remains unstable and unpredictable,” the State Department said, pointing to recurring incidents of communal clashes, armed banditry, and abrupt security operations.

 

It further warned that violent crimes such as armed robbery, carjacking, and ransom kidnappings are widespread, adding that U.S. citizens are often targeted due to perceived affluence.

 

The department also cautioned that terrorist attacks could occur without warning in public spaces such as markets, malls, hotels, places of worship, and large gatherings.

 

Additionally, it raised concerns about Nigeria’s healthcare system, describing medical services as limited and inconsistent, often below U.S. or European standards.

 

Americans who must travel to Nigeria were advised to enroll in the Smart Traveler Enrollment Program (STEP) for real-time alerts, avoid protests and crowded areas, and adopt strict personal safety measures, including establishing “proof of life” protocols.
