Sexual Harassment Trial: Dismiss Ndifon Lawyer’s No Case Submission- ICPC tells Court

The Independent Corrupt Practices and Other Related Offences Commission (ICPC) has urged the Federal High Court, Abuja to dismiss the no case submission application in the sexual harassment trial of the suspended Dean of Faculty of Law, University of Calabar, Professor Cyril Ndifon and his lawyer, Barrister Sunny Anyanwu.

The Commission is prosecuting Ndifon and Anyanwu before Hon. Justice James Omotosho of Court 8 over an alleged sexual misconduct and attempt to perverse the cause of justice contrary to Sections 8, 18 and 19 of the Corrupt Practices and Other Related Offences Act, 2000 and Section 182 of the Penal Code Cap. 532 Laws of the Federal Capital Territory, Abuja, 2006.

At the resumed hearing on Tuesday, counsel to the two defendants, Mr. Joe Agi, SAN told the court that upon the receipt of ICPC’s reply to the written address on the nocase submission application, the defence had resolved to rely on the same argument to the court to allow the no case submission.

He also argued that the position of the defendants was that in the originating process, “the court lacks jurisdiction to hear the case.”

Citing Section 26 subsection 2 of the ICPC Act, Mr. Agi said it is only the state or the FCT High Court that has jurisdiction to hear the case adding that territorial jurisdiction also applies since the alleged offences took place in Calabar, Cross River State hence it should be heard there and not in Abuja.

The counsel to the defendants also told the court that ICPC invaded the privacy of his clients as the Commission ‘failed’ to secure a court order before it subjected the phones of the first and second defendants to forensic examinations.

“You do not invade anyone’s privacy unless you come to court and ICPC did not answer that when the question was posed to it. Again, TKJ (the 2nd Prosecution witness) never complained to anyone about her affair with the first defendant but ICPC broke their privacy by sharing their private pictures. TKJ is an adult and once you are above 18, you are at liberty to do what you like”, he argued.

In his response, Counsel to ICPC, Dr. Osuobeni Ekoi Akponimisingha told the court that the prosecution had established a prima facie case against the defendants hence the prayer for the dismissal of the no case submission filedby their counsel.

He added that the position of the prosecution was that the defendants’ argument on the court’s jurisdiction to hear the case lacked merit as all matters that has to do with cybercrime, as provided for in the Cybercrime Act are instituted in the Federal High Court.

On the allegation that ICPC invaded the privacy of the defendants by subjecting their phones to forensic investigations, Akponimisingha argued that the defendants were already under investigation and they also signed a consent form allowing access to their respective phones and opined that “no right is absolute”.

He cited Section 45 of the 1999 Constitution which saysthat nothing in Section 37 (of the same Constitution) that dwelled on privacy of citizens can invalidate any law on public morality which the case is hinged on.

The trial judge, J. K. Omotosho thereafter adjourned the case to March 6, 2024 for ruling on the no case submission as well as the application for variation on bail granted to the first defendant.

NLC begins protest in Abuja, Lagos against hardship under Tinubu

Nigeria Labour Congress has commenced its nationwide protest in Abuja and Lagos against economic hardship under president Bola Ahmed Tinubu’s administration.

The NLC, led by its president, Joe Ajaero, had accused the Tinubu-led government of reneging on most of the palliatives it promised to facilitate workers’ pains since the fuel subsidy’s removal on May 29th, 2023.

Most of the protesters were seen carrying placards with inscriptions like: “Tax the Rich, Subsidize the Poor”, ” Make Our Refineries Work Before Removing Subsidy”, and “Let the Poor Breath”, “#END HUNGER AND POVERTY NOW!” among others.

The protest comes despite warnings from the Department of State Services (DSS) and some civil society groups against the rationality of organizing a mass protest against economic hardship in the country.

Meanwhile, unlike in the previous protest, the Trade Union Congress and TUC members did not partake in the civic exercise.

 

 

 

 

Nnamdi Kanu knows fate over bail on March 19

Justice Binta Nyako of the Federal High Court in Abuja has fixed March 19 for ruling in the application by Nnamdi Kanu seeking to be admitted to bail.

The Judge fixed the date after taking arguments from Kanu’s counsel, praying for bail for his client and Adegboyega Awomolo, who stood for the federal government and vehemently objected to the granting of bail.

Kanu predicated his request mainly on the fact that he may only be able to put up a good defence if admitted to bail to have unfettered access to his lawyers.

He also claimed to be suffering from acute hypertension and acute heart disease, among others.

The federal government, however, objected on the ground that Kanu was once granted bail but jumped and fled the country.

The government asserted that all the bail conditions set by the court were breached and violated and pleaded with the court to dismiss the request.

The leader of the proscribed Indigenous People of Biafra, IPOB, also argued another motion where he asked the court not to allow continuation of his trial until the federal government meets certain conditions.

He requested that DSS operatives be barred from interfering with his lawyers during visitation.

He also asked that the court compel the federal government to wear the clothes of his choice.

The federal government, however, objected to the request on the grounds that he had no right under any law to dictate how his trial should be conducted.

Awomolo, while seeking the dismissal of the request, said that it was a gross abuse of the court process that must not be allowed.

Economic Hardship: Protest rocks Lagos streets

Lagos State residents storm the streets on Monday to protest against the high level of hardship in the country.

Nigerian Newssphere gathered that the ongoing protest was facilitated by a human rights group identified as the ‘Take It Back Movement’.

The protesters were seen carrying placards with various inscriptions that expressed their grievances at the Ojuelegba Under Bridge area of the state.

This is coming hours to the planned mass protest scheduled for February 27 and 28 by the Nigerian Labour Congress, NLC.

Newssphere recalls that there was a similar protest in Niger, Kogi, and Oyo states over rising hardship.

According to the National Bureau, Nigeria’s food inflation increased to 35.42 per cent in January 2024.

 

Hardship: Protest’ll hold as planned – NLC president, Ajaero dares Tinubu govt

The Nigeria Labour Congress, NLC, has insisted that its planned Tuesday and Wednesday’s protest over the “mounting hunger and insecurity” in Nigeria will go on.

NLC President, Joe Ajaero, disclosed this in a statement on Sunday.

Ajaero accused the Federal Government of allegedly trying to use an amorphous group, Nigeria Civil Society Forum (NCSF) to attack its members during the rallies.

He vowed to ensure a total shutdown of Nigeria through the withdrawal of services by workers if any of its members were attacked during the protest.

Recall that the Department of State Services has warned that the planned protest may be hijacked by “some elements.”

This was as the Attorney General of the Federation and Minister of Justice Lateef Fagbemi, warned that embarking on the rallies would be contempt of court.

However, the statement reads: “We would want to inform Nigerians that the State has perfected plans to attack our peaceful rallies across the country.

“One of the groups being primed to attack our peaceful rallies is by a nebulous name, Nigeria Civil Society Forum (NCSF).

“NCSF is one of the emergency groups put together, funded, promoted and remote-controlled by the government to cause violence against our members for electing to peacefully protest against hunger in the land.

“We however remain resolute, determined and prepared to express our pain and grief in a peaceful manner as Nigerians come 27th and 28th of February 2024.”

Liverpool beat Chelsea to win 23/24 Carabao Trophy

Liverpool defeated Chelsea at the extra time to emerge winners of the 23/24 Carabao Cup on Sunday.

Vigil Van Dijk lone goal at the 118 minutes gave the Reds the much awaited victory.

Earlier, Dijk goal at the 60 minutes was ruled out by VAR.

This is the first trophy Liverpool’s Manager, Jurgen Kloop will be lifting after announcing his planned exit.

ECOWAS lifts all sanctions on Niger, Burkina Faso, Mali

The Economic Community Of West African States, ECOWAS has lifted its sanctions on Niger Republic, Burkina Faso and Mali.

This was the outcome of the meeting of ECOWAS members in Abuja on Saturday.

Recall that the West African bloc had in a swift response to the military coup in Niger, enforced a no-flight zone over the country.

ECOWAS to the decision taken on July 30 2023 following the increasing tension stirred by the military actors who took over in the West African country.

The Nigerian government also cut off power supply to military-ruled country to persuade the juntas to restore democracy in the country.

Also, suspension of financial transactions between ECOWAS and Niger.

However, at the meeting in Abuja on Saturday, all sanctions were lifted.

In Janaury Niger, Mali and Burkina Faso  announced that they were withdrawing from ECOWAS due to what they called illegal and inhumane sanctions imposed on them following the coups in their countries.

Recall Niger’s President Mohamed Bazoum was detained by members of the Presidential Guard on July 26, and that evening, the military juntas announced that it had seized power.

 

 

EPL: Four matches to expect shock results this weekend

This weekend will be the Matchday 26 of the current English Premier League campaign.

There will be interesting fixtures across the United Kingdom at both ends of the table.

Only Chelsea and Liverpool won’t be playing, as they face each other in the Carabao Cup final on Sunday.

So, what four matches could we see shock results on Saturday?

1. Man Utd vs Fulham: There was bad news for United, after the club revealed that Rasmus Hojlund will miss the next three weeks with a muscle injury. The Danish striker has found form from the turn of the year and his two goals is why Ten Hag’s men beat Luton 2-1 the last weekend. His absence leaves the out-of-sorts Marcus Rashford to lead the line. For Fulham, this will be music to their ears.

2. Bournemouth vs Man City: Pep Guardiola’s men have not been at their best in recent fixtures. They could have easily lost to Chelsea in the 1-1 draw and it took an Ajer’s slip for Haaland to grab the winner in the 1-0 win against Brentford. Bournemouth are not only in good form, they have a reborn Dominic Solanke upfront and will be playing at home. Expect anything.

3. Arsenal vs Newcastle: The Gunners are easily the in-form team in the Premier League in 2024. Mikel Arteta’s men have scored 21 times this new year, as their attack has finally clicked. But they came undone against FC Porto in the Champions League last-16 first leg on Wednesday. Newcastle will deploy similar tactics like the Portuguese side and could leave the Emirates with a result.

4. Aston Villa vs Nottingham Forest: There was time this season that Unai Emery’s men looked like they would genuinely challenge the top three for the title. But they have fallen off in recent weeks and could even lose out on Champions League places. Forest have been boosted by the return to form of Taiwo Awoniyi and some players that went to the AFCON and will go to Villa Park confident.

 

 

NIN: Make sure everyone is enrolled- NIMC DG Coker-Odusote charges FEPs

Engr. Abisoye Coker-Odusote, Director General and CEO of the National Identity Management Commission (NIMC), has charged the Commission’s Front End Enrolment Partners (FEPs) to ensure that no one is left out of the National Identity Number (NIN) registration process.

The NIMC Chief Executive delivered the charge on Friday while addressing attendees at the Commission’s Management Retreat.

She also tasked them with complying with the terms of the Nigerian Data Protection Act.
She further advised enrollment agents and commission personnel to be professional when providing services to members of the public.

“Our mission at NIMC is clear: to equip each Nigerian and legal resident with a unique and secure National Identification Number (NIN). This number is the key to accessing critical services, social benefits, and economic prospects.
However, in order to accomplish this, we must ensure the integrity of our enrollment process.

“As FEPs, your involvement is crucial. You are the link between our citizens and the NIMC enrollment ecosystem. As you communicate with candidates, treat their information with care, accuracy, and thoroughness. Let us work together to protect our database from errors, fraud, and other threats to its integrity.

“While we welcome the expansion of our National Identity Database to over 104 million captured NINs, we cannot rest on our laurels. Millions more are waiting to be enrolled. They include students, farmers, businesspeople, and the elderly. They are the heartbeat of our country.

“Let us reach out to all parts of Nigeria, from booming cities to isolated villages. Allow us to collaborate with schools, hospitals, and community leaders. Let us ensure that no one is left behind, including the vulnerable, people with disabilities, those living in remote locations, and so on. Let us make the NIN enrollment process accessible, fast, and inclusive.”

Continuing, Coker-Odusote entrusted the FEPs with professional behaviour and excellent communication, citing these as vital to success.

“When an applicant enters an enrollment centre, they put their trust in us. They are certain that their personal information will be kept confidential, that their NIN will be secure, and that it will open opportunities for them. We must honour that confidence.”

In her presentation on NIMC Ecosystem Enrollment, the Commission’s Director of Business Development and Commercial Services, Mrs. Carolyn Folami, told the FEPs that the revalidation effort was intended to sanitise the system while correcting identified gaps.She utilised the opportunity to announce the start of payment of the remaining arrears owing to the FEPs, assuring them of the commission’s commitment to settling the outstanding balance as soon as possible.

“So far, 96 FEPs have been revalidated. It is still under progress, and as more are revalidated, they will be onboarded. This month (February), we began paying the FEPs’ outstanding arrears in accordance with the DG/CEO’s earlier promise. We have now paid well over 15 companies and are attempting to clear the arrears. We’ve done some housekeeping. Currently, we are only working with Android smartphones”.

In other news, Front End Enrollment Partners (FEPs) of the National Identity Management Commission (NIMC) have praised the government led by Engr. Abisoye Coker-Odusote for paying the outstanding arrears owed to them.

The FEPs addressed on Friday at the National Identity Management Commission’s Management Retreat, taking turns thanking the Commission’s Director General and Chief Executive Officer, Engr. Abisoye Coker-Odusote, for the payment.

Speaking on the ongoing revalidation effort, the FEPs welcomed it as a step in the right direction, stating that it was intended to sanitise the system. One of the FEPs, Tunde Ogunmola, Partner, Jibyes Consulting, hailed Friday’s discussion with the Commission’s Director General as timely and powerful.

“We have been looking forward to our meeting with the DG/CEO of NIMC. It’s an opportunity to interact while increasing enrollment.” We need more of this type of interaction to improve performance.”

“The ongoing revalidation is an essential step to sanitise the system, as many things were not working properly prior to this point. I can certainly certify that payment has begun. Jibyes Consulting has received payment from the NIMC, and we are pleased.”

Chinaka Obi-Ezenwugo of Miandkay Enterprise emphasised that “revalidation helps NIMC separate the chaff from the wheat. It was an extremely clear process. I can also confirm that we’ve been paid. It’s a huge relief.”

The 5-day retreat, with the theme “NIMC’s 5-point Agenda on Strategy Development and Implementation,” was part of the process of obtaining stakeholder buy-in to the current administration’s initiatives while also seeking long-term answers to the Commission’s difficulties.

The retreat’s highlights included paper presentations, interactive meetings with the NIMC DG/CEO, breakout sessions, presentations on implementation updates, and team bonding exercises.

 

Monday Okpebholo wins APC Edo guber ticket

Senator Monday Okpebholo has won the Edo State All Progressives Congress, Gubernatorial primary election.
Governor Bassey Otu of Cross River who was the Chairman of Edo APC poll, made the declaration after collating the results from the 18 local government areas.
Okpebholo scored 12,433 votes to defeat  Dennis Idahosa, who scored 6,541 votes.
The collation and declaration were at Lushville Hotel and Suites, Gapiona Avenue, Government Reservation Area (GRA), Benin.
Nigerian Newwsphere recall that Dennis Idahosa had been declared winner of primary conducted by Imo state governor, Hope Uzodinma.
However, the Party’s National Working Committee declared the election inconclusive and replaced Uzodinma with Otu.
