Money laundering: Why Appeal Court convicted Delta Senator, Nwaoboshi to seven years behind bars

The Lagos Division of the Court of Appeal on Friday convicted and sentenced Senator Peter Nwaoboshi, senator representing Delta North Senatorial District at the National Assembly, to seven years imprisonment along with his two companies: Golden Touch Construction Project Ltd and Suiming Electrical Ltd.

This was contained in a statement from the Economic and Financial Crimes Commission (EFCC), which prosecuted the case.

In addition, the Court of Appeal ordered that the companies who were the second and third respondents in appeal be wound up in line with Section 22 of the Money Laundering (Prohibition) Act, 2011 (as amended) and their properties forfeited to the Federal Government.

The panel, comprising Justices Abdullahi Bayero, Obande Ogbuniya and Peter Affen in their judgment held that the trial court erred because the prosecution proved its case beyond reasonable doubt against the respondents and thus reversed the earlier judgement discharging and acquitting the respondents.

The EFCC had challenged the judgment of Justice Chukwujekwu Aneke of the Federal High Court which on June 18, 2021 discharged and acquitted the defendants of a two count charge of fraud and money laundering.
EFCC had arraigned the three defendants over the acquisition of a property named Guinea House, Marine Road, in Apapa, Lagos, for N805 million. Part of the money paid to the vendor, precisely a sum of N322 million transferred by Suiming Electrical Ltd on behalf of Nwaoboshi and Golden Touch Construction Project Ltd , was alleged to be part of proceeds of fraud.
But in his judgment, Justice Aneke held that the prosecution failed to call vital witnesses and tender concrete evidence to prove the elements of the offences for which it charged the defendants.

Justice Aneke said the evidence of PW2 “proved that the third defendant obtained a loan of N1.2 billion from Zenith Bank for purchase of additional equipment and as provision of working capital.

“It also proved that the loan of N1.2 billion together with interest of N24 million was properly granted to the third. Nothing else was proved by the complainant or prosecutor in this case,” the judge said.

He claimed a fatal blow was dealt the case of the prosecution by its failure to call officials of Sterling Bank “to testify and probably tender exhibits F and F10”.

Consequently, he discharged and acquitted the defendants.

However ruling on the EFCC’s appeal on Friday, the Court of Appeal held that the trial judge erred in dismissing the charges against the respondents. It said the prosecution had proved the ingredients of the offence and consequently found the defendants guilty as charged.

 

Actress Jenifa, JJC Skillz join list of ‘crashed celebrity marriages’ in Nigeria

The marriage between popular Nigerian actress and movie producer, Funke Akindele, a.k.a Jenifa and musician Abdulrasheed Bello known as JJC Skillz, joined the list of crashed celebrity marraiges in Nigeria.

This is as JJC Skillz officially confirmed the rumour which has been going on for months over strayed relationship.

The marriage lasted for six years before this separation.

The musician and film maker, confirmed this on his verified Instagram handle, saying he is now separated from Funke Akindele as reconciliation moves to mend the cracks in their marriage have not been unsuccessful.

In his post, Abdulrasheed Bello wrote, “Dear Friends and family I need to let you know that Funke and I have separated. While it lasted we shared a lot of things together and have created 2 beautiful children”.

“The last two years have been extremely difficult for us. I know I have tried my best to fix things but I believe it is beyond repair now. 3 months ago and at Funke’s insistence I moved out of the house and apart from AMVCA have not been able to get Funke to sit down in an amicable manner to discuss the future of our relationship”.

“I’m making this announcement so that the public is clear that we both are pursuing separate lives. We still have issues that need to be addressed such as the custody and wellbeing of our children which is paramount as well as business interests which need to be disentangled but I have no doubt that these will be resolved one way or the other”.

Funke Akindele and Abdulrasheed Bello, who got married in 2016, have twins from the marriage. This is Funke Akindele’s second marriage as her first marriage with Kehinde Adeola Oloyede, which was consummated in May 26, 2012, packed up in 2013, just over a year, citing irreconcilable differences.

Reacting to the development, Nigerians on Twitter on Thursday, just a few minutes after celebrity musician and filmmaker, JJC, announced his separation from his wife, Nollywood actress, Funke Akindele.

2023:INEC bows to pressure extends CVR indefinitely

Independent National Electoral Commission (INEC) finally succumbed to pressure from Groups, Nigerians, has extended the Continuous Voter Registration (CVR) indefinitely.

INEC Commissioner for Information and Voter Education, Peter Okoye disclosed this Newssphere.

Okoye, in a statement issued yesterday, after the INEC management meeting also said the Commission is working to process and issue certified true copies of all documents.

The statement reads in part: “The Independent National Electoral Commission (INEC) met today, Thursday 30th June 2022 and deliberated on a number of issues, including the Continuous Voter Registration (CVR) exercise, the issuance of Certified True Copies (CTCs) of documents and the commencement of the Uploading of the List and Personal Particulars of Governorship and State Assembly Candidates.

Continuation of the Continuous Voter Registration

“The Continuous Voter Registration (CVR) will continue nationwide, and all the Resident Electoral Commissioners and Electoral Officers have been directed to continue with the exercise pending further directives from the Commission. The Commission has consistently reiterated its resolve to continue to provide electoral services to the Nigerian people and register all eligible Nigerians that are interested in registering. The Commission has yet again deployed additional machines to areas of pressure and will continue to serve the people of Nigeria.

“Furthermore, the case at the Federal High Court relating to the terminal date of the CVR came up yesterday Wednesday 29th June 2022, and based on the request of the Commission, the Court granted an accelerated hearing and adjourned the matter to Monday 4th July 2022 for hearing of the substantive matter. The Commission will give an update after court hearing next week.”

On the issuance of Certified True Copy (CTC) of Documents, the statement further reads: “The Commission has been inundated with applications for CTCs of various documents. So far, 186 requests for CTCs, some running into hundreds of pages, have been processed. The Commission is working round the clock, including weekends, to attend to all such requests. We wish to assure political parties, aspirants, candidates, and all applicants for CTCs of documents that their applications will be treated expeditiously and will be issued in earnest.”

The Commission urged political parties to be meticulous as they upload the list and particulars of nominated candidates to avoid any error.

“By the Timetable and Schedule of Activities released by the Commission, Political Parties that conducted valid Governorship and State Assembly primaries shall upload the list and personal particulars of their nominated candidates between 1st and 15th July 2022. We urge political parties to scrutinize the list and personal particulars of the candidates they propose to sponsor at the election to avoid any mix-up and duplication of names. Political parties are advised not to wait until the last day before uploading the list and personal particulars of their candidates. The Candidates Nomination Portal will shut down at 6pm on 15th July 2022. Political parties that have challenges with uploading documents should contact the Commission’s Help – Desk, through the dedicated telephone lines or contact the candidate nomination centre at the Commission’s headquarters” the statement concludes.

Undeserved communities will get broadband, NCC assures

Nigeria’s grass root communities and the underserved population of the country will not be left out of the national broadband plan when the implementation comes to fruition.

Speaking in Lagos at a session which discussed the critical issue of financial inclusion expected to be facilitated by a robust infrastructure deployment for broadband availability, the Executive Vice Chairman of the Nigerian Communications Commission, Prof. Umar Garba Danbatta, said the Commission is mindful of the infrastructure gaps in the country and therefore, committed to driving national digital economy to the grassroots.

“As a Commission, we have a mandate to ensure availability of universal access to telecom services irrespective of circumstances and location of Nigerians and other users in Nigeria,” said Bruce-Bennet, who also informed the audience that voice communications enjoys over 100 per cent penetration.

The EVC of NCC who spoke through Freda Bruce-Bennet of the Digital Economy Department, reiterated the Commission’s focus in supporting the quest for financial inclusion through provision of robust infrastructure such as broadband.

At the event hosted by Oriental News Nigeria, an online news organisation, at the Sheraton Hotels, Ikeja, Lagos, which focused on: “Engaging with Critical Grassroots Groups to Develop Effective Financial Inclusion Initiatives”, Bruce-Bennet, said the Commission has been at the forefront of driving technology platforms required to drive increased access to financial services by all and sundry.

She cited the current implementation of an open access model (Infraco licensing) for deployment of broadband infrastructure in the six geopolitical zones, as well as Lagos (which enjoys a special status within telecom ecosystem), as one of the strategies adopted by the Commission to ensure a robust infrastructure deployments that will support many platforms that can accelerate financial inclusion.

Bruce-Bennet said that the Commission had facilitated strategic partnerships with the Central Bank of Nigeria (CBN), the Fintech Association of Nigeria (FintechNGR), the International Telecommunications Union (ITU), Rockefeller Partnership Agreement (RPA), and other government agencies, to promote Digital Financial Services (DFS) and Digital Financial Inclusion (DFI) in Nigeria.

Bruce-Bennet also stated that the NCC, through its Digital Economy Department, is fostering the development of a portal for the Association of Skilled Vocational Artisans of Nigeria (ASVAN) for information and digital training purposes.

At the event, the Chairman, Bank Customers Association of Nigeria, Dr. Uju Ogubunka, applauded the Commission for its regulatory efforts in creating an enabling environment for digitized financial inclusion, and charged the participants and other government agencies present to take advantage of the information portal of the Commission to glean necessary information because robust digital economy will, amongst other things, improve the standard of living of the people who are willing to harvest the benefits.

Civil rights advocacy group, Human Rights Writers Association of Nigeria(HURIWA), on Thursday, said the alleged diversion of $7 billion petrol subsidy under the regime of the President Muhammadu Buhari, is the very height of gargantuan corruption that has infested the present administration in the past seven years.
HURIWA’s National Coordinator, Comrade Emmanuel Onwubiko, in a statement, urged civil society organisations and rights activists to drag the Buhari regime to court to put an end to the criminal corruption ongoing in the present administration.
The group also said it is heartless of government officials to divert a whopping $7bn meant for subsidy payment on Premium Motor Spirit whilst Nigerians groan of fuel scarcity and hike in prices of petrol (now over N180 per litre) and diesel (which now sells at over N800 per litre).
Recall that the House of Representatives set up an ad-hoc committee to investigate the petroleum products subsidy regime under Buhari from 2017 to 2021, following the adoption of the motion by Hon Sergius Ose Ogun.
The lawmaker had said there exist evidence that subsidy amounts are being duplicated, noting that the subsidy regime has been “unscrupulously” used by the Nigerian National Petroleum Company Limited and other stakeholders to subvert the nation’s crude oil revenue to the tune of over $10 billion, with records showing that as at 2021, over $7bn in over 120 million barrels have been so diverted.
NNPC also recently said it spent N9.11bn in each of the months of January, March and April, amounting to N27.33bn to rehabilitate the nation’s refineries that haven’t produce a single drop of oil since only God know.
“The House of Representatives on diversion of petrol subsidy to the tune of $7bn if established  and substantiated is another proof that the regime of President Muhammadu Buhari is infested with corrupt criminals and thieves but who pretend to be saints.
“It is altogether befuddling that the more the government spend, the worst and most dysfunctional the refineries become which simply explains the fact that the funds are been siphoned. The government blame subsidy for our economic mess and the non availability  of sufficient  petrol whereas these humonguous cash are diverted to the pockets of individuals who take delight in watching common Nigerians groan at filling stations and buying fuel at exorbitant rates after hours of queueing under intense sun.
“It is just unfortunate that the Buhari government has condone corruption so much that it has become daily affairs. The case of the suspended Accountant General of the Federation, Ahmed Idris; the disgraced immediate-past Chief Justice of Nigeria, Tanko Mohammed; amongst others suffice.
“HURIWA warns the House of Representatives not to use this investigative hearing as a blackmailing opportunity to raise dollars for their political campaigns which starts in September.  This is because there have been many probes by this same legislature since 2019 with no results to show but smokescreen to collect bribes.
“HURIWA also enjoins civil society organisations to drag the Economic and Financial Crimes Commission to court for not doing its work. Also, the NNPC should be joined in the suit and should be made to explain how every kobo was spent.
“The NNPC Group Managing Director, Mele Kyari, if he has any shame at all, should resign if it substantiated that  he failed to transparently declare how monies on petrol subsidy are spent and how $7bn got diverted under him.”

An Inter-religious group, Interfaith Coalition Conference, has called on the Ruling Party, All Progressives Party(APC), Labour Party(LP) to opt for a Christian and Muslim as running mates respectively in the forthcoming Presidential election.
The group made this call on Thursday in Abuja while addressing Journalists.
The Co-Chairman, Interfaith Coalition Conference and Former National President, Youth Wing of CAN(YOWICAN), said the call for Muslim-Christian or Christian-Muslim ticket will bring about balance, equity, justice and fairness in the democratic process of Nigeria.
He disclosed that a balance ticket will help manage the Country’s diversity.
He also stated that the nation needs an all inclusive administration required to tackle spate of insecurity across the country.
“The major challenge we are having in this country is lack of equity and fairness, the nation is fast drifting and the we can’t fold our hands and allow the country to derail, we need to save this nation from collapse
“We need to manage our diversity, chart the way forward for peace, politics is not about acrimony or fighting, politics is about choice of credible people who can represent this nation.
“Look towards getting a leader that can manage our diversity, we are looking forward to an inclusive nation. We are in a political dispensation and the transition process has started and we need to bring our people together.
“We are tired of the killings and kidnappings going on in the country, we can’t continue this, government should review the security architecture, we need leaders that will take responsibility, we have credible people in all the tribes and religion, this issue of Muslim /Muslim ticket or Christian /Christian ticket by some political parties should be reviewed, you cannot come and fly such an agenda, political parties shouldn’t create problems for us in this country. If for any reason we want to have a peaceful political process, why did the APC not pick a northern Christian as the Vice presidential candidate and why did the Labour party not pick a northern Muslim to balance the whole process. Our problem is this country is managing our cultural and religious diversities in order to have a balanced political process. Those trying to divide us in this nation must understand that we are now awake and we are going to engage our people at all levels to resist this spirit of division in the interest of the country.
“We don’t want division in this country, Muslim /Muslim or Christian /Christian tickets is not the best for a country that is very fragile, with overwhelming mutual suspicion, it is a hoax to divide this nation and we cannot tolerate it. We will mobilize our people to vote against that political party and we will go to any length to mobilize against anything that will cause division in this country”, he stated.
In a similar call, a member of the group, Sen. Abubakar Mahdi representing Borno South Senatorial District stressed that a balance ticket cannot be negotiated in the selection of presidential running mates in APC and LP.
He revealed that Governor of Plateau State, Simon Lalong is a perfect fit for APC’s presidential flag bearer, former Governor Ahmed Bola Tinubu running mate.
According to him, “A Christian Northern should be taken as Running mate. The person that is most qualified is the Governor of Plateau State, Simon Lalong.
“Let me say without any fear that I have no relationship with Lalong but I am saying this because of fairness, equity and Justice.
“Ahmed Bola Tinubu, the APC presidential flag bearer is my friend, he won the APC ticket. Former Rivers State Governor, Rotimi Amaechi came up the as the second runner up during the APC presidential primaries, if Governor Simon Lalong supported Ameachi, in fact they shouldn’t have left the Eagle Square before announcing Lalong as Tinubu’s running mate”, he said.

5G deployment: FG okays Microsoft Enterprise Agreement, migration of C-band services

The Federal Executive Council(FEC) has approved an Enterprise Licensing Agreement for Microsoft Products and the clearing up of C-band Spectrum, in order to accelerate the deployment of 5G services in the country.

According to the Technical Assistant (Research & Development) to the Honourable Minister of Communications and Digital Economy, Dr Femi Adeluyi the approval was given on Wednesday during FEC meeting in Abuja.

This followed the presentation of 3 memos by the Honourable Minister of Communications and Digital Economy, Prof Isa Pantami.

The Government-wide Enterprise Licensing Agreement for Microsoft products is a software acquisition cost-reduction strategy for government and it will be implemented by the National Information Technology Development Agency (NITDA), under the supervision of the Federal Ministry of Communications and Digital Economy (FMC&DE). This agreement is part of the Federal Government’s efforts towards keeping the cost of IT projects within sustainable levels.

The Agreement will give the government access to discounted prices and other cost benefits, as well as reduce project duplication across Federal Public Institutions (FPIs). It will also guarantee proper technical support for Microsoft products and services, thereby ensuring protection against cybersecurity threats, which will guarantee availability and reliability of government IT services.

The Enterprise Licensing Agreement will provide a projected savings of a minimum of 35% of Governments current investment in Microsoft Products and Services. This will not only substantially reduce the cost of license procurement for FPIs, it will reduce and simplify licensing complexity, facilitate accounting and cash flow predictability and monitor utilisation and impact of Government investment. The Council directed all FPIs to key into the Agreement in the procurement of Microsoft licenses and services.

Council also approved the request of the Nigerian Communications Commission (NCC) to clear part of the C-band spectrum within the country’s telecommunications industry of any encumbrances and migrate the current users on affected spectrum, towards the successful roll-out/deployment of 5G technology in Nigeria.

Furthermore, with seven and a half (7.5) years before the end of the lifetime of NigComSat-1R Satellite, operated by Nigerian Communication Satellite Limited (NIGCOMSAT), which currently operates C-Band services on the 3.4 – 3.9GHz spectrum range, NCC and NIGCOMSAT have come to an agreement to relocate/migrate the operations of NigComSat-1R C Band service to another frequency (Standard C Band) and release its current frequency for immediate deployment of 5G in the country.

The approved memos will accelerate the implementation of the National Digital Economy Policy and Strategy (NDEPS), especially the pillars on solid infrastructure (broadband) and service infrastructure (platforms). The Ministry will continue to promote initiatives that will transform Nigeria into a country with a sustainable and thriving digital economy.

US Court sentences R.Kelly to 30years in prison over sex trafficking crimes

US singer R. Kelly has been sentenced to 30 years in prison for using his celebrity status to sexually abuse children and women.

The R&B artist, 55, was convicted last September in New York of racketeering and sex trafficking crimes.

He had faced years of allegations and the judge on Wednesday said he had an “indifference to human suffering”

Lawyers for the singer, whose real name is Robert Sylvester Kelly, say he will appeal.

Ahead of his sentencing, a handful of women took the stand to confront Kelly.

A woman identified only as Angela called the singer a Pied Piper who “grew in wickedness” with every new victim, while others who were not named testified he had broken their spirits.

“I literally wished I would die because of how you made me feel,” said one.

Dressed in prison khakis and dark glasses, Kelly declined to make a statement of his own and did not react as the verdict was handed down.

District Judge Ann Donnelly said the celebrity had used sex as a weapon, forcing his victims to do unspeakable things and saddling them with incurable diseases.

“You taught them that love is enslavement and violence,” she said.

The court heard how Kelly – known for hit songs like I Believe I Can Fly and Ignition – used his influence to lure women and children into sexual abuse over two decades.

Jurors at his six-week trial in Brooklyn heard how he trafficked women between different US states, assisted by managers, security guards and other members of his entourage.

The court also heard how Kelly had illegally obtained paperwork to marry singer Aaliyah when she was 15 in 1994, seven years before the singer died in a plane crash.

The certificate, leaked at the time, listed Aaliyah’s age as 18. The marriage was annulled months later.

Federal prosecutors had recommended that Kelly be sentenced to more than 25 years in prison, given the seriousness of his crimes and “the need to protect the public from further crimes”.

But his lawyers called for a sentence of 10 years – the mandatory minimum for his conviction – or less.

They portrayed Kelly as growing up poor in a household rife with domestic violence and suffering sexual abuse from a young age.

They said he was “devastated” by the sentence and planned to appeal.

Kelly has been in custody since he was indicted by federal prosecutors in New York and Chicago in July 2019.

His three years behind bars have been eventful, including a beating from a fellow inmate in 2020 and a bout with Covid-19 earlier this year.

The singer faces further legal action in August, when he goes on trial again, this time in Chicago on child sex images and obstruction charges.

He is also due to face sex abuse charges in courts in Illinois and Minnesota.

 

Who says Easterners cannot takeover from President Buhari? Popular Pastor, Enenche, asks

The Senior Pastor of Dunamis International Gospel Centre, Dr Paul Enenche, has questioned why a south-easterner can’t takeover from President Muhammadu Buhari.

He said this as the nation prepares to elect political office holders in the 2023 election and intrigues still surrounds the zone who should produce the nation’s next president.

In a video posted on his Instagram page on Wednesday, Eneche said, “What is wrong if it is narrowed down for example to south-east? A people who have felt marginalised and oppressed for a long time. Who said that an easterner cannot be a president of Nigeria? What did they do? What is the offence? Who said it? Where was the law made from?

“Go to the South-East once. Those who have gone before are also clamoring to go again, as if some people are not a people. Such uselessness is also happening in some states.”

 

Abuja-Kaduna train victim shot in captivity, says negotiator

One of the passengers of the Kaduna-bound train that was attacked by terrorists in March has been shot in captivity, DailyTrust reported.

According to Tukur Mamu, the publisher who has been negotiating with the terrorists, the victim identified as Mohammed Al’amin is currently in a critical condition.

Mamu, who facilitated the release of 11 of the passengers, confirmed the development.

“I can confirm to you that the said passenger has been shot and the information is credible. It could also be intentional from them for the purpose of sending a message. Killing of their victims is something we know they can do. They have threatened to do that before,” he said.

He said the government must be prepared to take full responsibility if they fail to act on time.

Mamu said there has been constant communication but government is yet to take action.

“I know what is in this crisis and that is why I keep emphasising that President Buhari must be prepared to take painful compromises if they are really committed to securing these innocent victims alive,” he said.

“With what we have succeeded in doing, the windows and opportunity we opened which there’s none hitherto, the government has the power to bring this to an end within three to four days.

“I assure them we can do it with their support and cooperation, and if it didn’t happen as long as government do the needful I will agree and accept to take full responsibility. Cases of emergency such as this doesn’t require unnecessary bureaucracy.”
Buhari has repeatedly ordered security agencies to ensure the release of the victims.
